Uluslararası Hukukun önemli isimlerinden biri olan Hans Kelsen göre devletler arası tanıma “biri siyasi, diğeri de hukuki olmak üzere iki farklı unsurun bir araya gelmesiyle oluşmaktadır. Siyasi tanıma, diplomatik ilişki kurmakla vücut bulur ve bu olguda tanıyan devlet, tanınan devlet ile ilişki kurma iradesini belirlemiş olur. Kelsen’e göre, “hukuki tanıma tanınan topluluğa hukuki varlık kazandırır.” Yani “hukuki anlamda var olma,” uluslararası bağlamda hukuki tanımayı getirir. Bir topluluğu hukuki bağlamda devlet olarak tanımak, o topluluğun devlet olarak varlığını uluslararası hukuk çerçevesinde kabul etmek anlamına gelir (Mackelm, 2008). Uluslararası Hukukta de facto, de jure, açık ve zimni tanıma türleri bulunmaktadır.
